Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations.

If you are a consumer (being an individual acting for purposes which are wholly or mainly outside that individual's trade, business, craft or profession) then you must not register with our site or proceed to place any orders for goods or form any contracts with us. We reserve the right to cancel any order for goods where we identify that the order has been placed by a consumer and not in a business to business context.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to you, which will be set out in our Terms and conditions of supply.

We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
a) use of, or inability to use, our site; or
b) use of or reliance on any content displayed on our site.
c) In particular, we will not be liable for:
d) loss of profits, sales, business, or revenue;
e) business interruption;
f) loss of anticipated savings;
g) loss of business opportunity, goodwill or reputation; or

15. We are not responsible for viruses and you must not introduce them
We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

17. Which country's laws apply to any disputes?
These terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

18. Our trademarks are registered
The Promat logo and the PROMASEAL, UNICOLLAR and PROMAFOUR brand names are registered trademarks of Etex Building Performance Limited. You are not permitted to use them without our approval, unless they are part of material you are using as permitted in accordance with these terms. Other trademarked brands may be added over time and will be indicated by the use of the ® trademark sysmbol.

We are committed to protecting and respecting your privacy. This policy (together with our terms of use above and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By visiting our site you are accepting and consenting to the practices described in this policy.

1.1 Information you give us
This is information about you that you give us (or our integrated third party secure payment gateway) by filling in forms on our site or by corresponding with us by phone, e-mail or otherwise. It includes information you provide, for example when you register to use our site, subscribe to our service, search for a product, place an order on our site, enter a competition, promotion or survey and when you report a problem with our site. The information you give us may include, but not limited to, your name, company name, address, e-mail address and phone number, financial and credit card information and personal description.

1.2 The transaction process.
The transaction process will be undertaken using an integrated third party secure payment gateway.

1.3 Information we collect about you.
With regard to each of your visits to our site we will automatically collect the following information:
(a) technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, email address browser type and version, time zone setting, browser plug-in types and versions and operating system and platform;
(b) information about your visit, including the full Uniform Resource Locators (URL), clickstream to, through and from our site (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any email address or phone number used to contact our customer services.

1.4 Information we receive from other sources.
This is information we receive about you if you use any of the other websites we operate or the other services we provide. We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies). 4.1 You agree that we have the right to share your personal information with:
(a) any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006;
(b) Selected third parties including:
(i) business partners, suppliers and sub-contractors for the performance of any contract we enter into with you;
(ii) advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we will provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in SW1). We may make use of the personal data we have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience;
(iii) analytics and search engine providers that assist us in the improvement and optimisation of our site; and (iv) credit reference agencies for the purpose of assessing your credit score where this is a condition of us entering into a contract with you.

4.2 We will disclose your personal information to third parties:
(a) in the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets;
(b) if Etex Building Performance Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets; and
(c) if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use or terms and conditions of supply and other agreements; or to protect the rights, property, or safety of Etex Building Performance Limited, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

5. Where we store your personal data
All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk.
